Protecting the vulnerable with s.28

If you’re a witness or victim of crime, the police, witness care services, and all those involved in the criminal justice system, work hard to support you through every step of the justice process. For many people however, presenting evidence and being cross-examined in open court can still be a daunting prospect.

It can be especially daunting for a child or a vulnerable witness – anyone under 18 or suffering from a mental or physical disorder, perhaps with impaired intelligence or social functioning. For these people, giving evidence in court, particularly where a sexual offence has been alleged and the most serious crimes, can be distressing and re-traumatising especially when awaiting the trial which may be some months away.

Section 28 of the Youth Justice and Criminal Evidence Act 1999 (s.28) allows the use of special measures to help children and vulnerable witnesses to give evidence in the best possible way. It supports those who otherwise may have compromised access to justice - to a justice system to which we’re all equally entitled.

As part of the crime team at HMCTS I’m responsible for managing the roll out of s.28 to more Crown Courts. This will support more children and vulnerable witnesses at a critical time as the criminal justice system puts in place a range of measures to assist a safe and swift recovery from the impacts of the coronavirus pandemic.

What s.28 means for children and vulnerable witnesses

As one of the special measures under the Act, s.28 allows for pre-recorded cross examination of witnesses to take place before trial, regardless of the offence. The recording is then played back during the trial itself, meaning they aren’t required to attend the trial in person.

Giving evidence earlier allows vulnerable people to do so closer to the time of the alleged offence. For many, this can be particularly important as their recall may be adversely affected by the passage of time.

It also enables some of them to put their experiences behind them sooner, rather than wait in anticipation for the trial. This can be critical in cases involving children as well as sexual offences, where attention can then be focussed on the recovery process.

The value and benefit of this special measure, for all parties, is undisputed and welcomed by all those who have seen it in action, including victim and witness support services, NSPCC, the Victims Commissioner and the judiciary.

How it works

A judge will set the timetable, usually at the Plea and Trial Preparation Hearing, for a ground rules hearing, s.28 hearing and trial. The ground rules hearing is held prior to the s.28 hearing and is when the questions to ask the child or vulnerable witness during the cross examination are agreed by all parties with the help of an intermediary where assigned.

At the s.28 hearing itself, the judge and counsel meet the witness, who will have witness support in place, in the witness suite. The witness then gives their evidence over a video link from there and it’s seen by everyone in the courtroom, including the defendant. This is the same process for video live links.

The video-recorded cross examination is then played at the trial.

Progress so far

S.28 was partially available from December 2013 - in Leeds, Liverpool and Kingston-upon-Thames Crown Courts - for child witnesses under 16 or witnesses vulnerable due to physical or mental disability. In January 2017, the provision was extended to all child witnesses under 18. We waited until we were completely confident in the quality of the recordings before rolling it out further.

The service was then introduced for the first time, for child and adult vulnerable witnesses, to six additional Crown Courts around the country. The introduction of a further nine courts in February this year means that s.28 has been available for vulnerable witnesses in at least one court in every region.

In June 2019, it was extended to adult complainants of sexual offences and modern slavery offences in the three original courts offering s.28. This is an ongoing pilot and its evaluation, delayed by COVID-19, will help to inform decisions on any further roll out.

Next steps

We’re now taking steps to roll out s.28 to all Crown Courts by the end of the year, starting this week with 16 new Crown Courts primarily in and around London.

We rightly take great pride in how fast and effectively we were able to adapt our services and ways of working when we had to over the last few months. I’m confident that the national rollout will not only support courts as part of their recovery from the coronavirus, but will benefit many more victims and witnesses.

I’m so grateful for the support the team has received from the judiciary, court staff, legal professional associations and victim and witness support services. We are united with a common purpose — not just in keeping the system running but also carefully considering impacts on those who use the courts and services too.

Beth mae a.28 yn ei olygu i blant a thystion bregus

Sut mae'n gweithio

Yn y gwrandawiad a.28 ei hun, bydd y barnwr a'r cwnsler yn cwrdd â'r tyst, a fydd yn cael help gan swyddog cymorth i dystion yn yr ystafell i dystion. Yna, bydd y tyst yn rhoi ei dystiolaeth dros gyswllt fideo o'r fan honno a bydd pawb yn y llys yn ei weld, gan gynnwys y diffynnydd. Dyma'r un broses ar gyfer cysylltiadau fideo byw.

Yna caiff y croesholi a recordiwyd ei chwarae yn y treial.

Y cynnydd hyd yn hyn

Roedd a.28 ar gael yn rhannol o fis Rhagfyr 2013 - yn Llysoedd y Goron Leeds, Lerpwl a Kingston-upon-Thames - ar gyfer tystion ifanc o dan 16 oed neu dystion bregus oherwydd anabledd corfforol neu feddyliol. Ym mis Ionawr 2017, estynnwyd y ddarpariaeth i bob tyst o dan 18 oed. Arhoswyd nes ein bod yn gwbl hyderus gydag ansawdd y recordiadau cyn ei gyflwyno ymhellach.

Yna cyflwynwyd y gwasanaeth am y tro cyntaf, ar gyfer tystion ifanc ac oedolion bregus, mewn chwe Llys y Goron ychwanegol ledled y wlad. Wedi hynny fe’i cyflwynwyd i naw llys arall ym mis Chwefror eleni, a golyga hynny bod a.28 wedi bod ar gael i dystion bregus mewn o leiaf un llys ym mhob rhanbarth.

Ym mis Mehefin 2019, fe'i hestynnwyd i oedolion sy'n achwynwyr yn achos troseddau rhywiol a throseddau caethwasiaeth modern yn y tri llys gwreiddiol a oedd yn cynnig a.28. Mae hwn yn gynllun peilot parhaus a bydd ei werthusiad, a ohiriwyd gan COVID-19, yn helpu i lywio penderfyniadau ar unrhyw gyflwyno pellach.

Y camau nesaf

Rydym bellach yn cymryd camau i gyflwyno a.28 i holl Lysoedd y Goron erbyn diwedd y flwyddyn, gan ddechrau'r wythnos hon gydag 16 o Lysoedd y Goron newydd yn Llundain a'r cyffiniau.

Rydym yn ymfalchïo'n fawr, a hynny'n briodol, o ran pa mor gyflym ac effeithiol yr oeddem yn gallu addasu ein gwasanaethau a'n ffyrdd o weithio dros y misoedd diwethaf. Rwy'n hyderus y bydd y broses o’i gyflwyno’n genedlaethol nid yn unig yn cefnogi llysoedd fel rhan o'u hadferiad o'r coronafeirws, ond y bydd o fudd i lawer mwy o ddioddefwyr a thystion.

Rwy'n ddiolchgar iawn am y gefnogaeth y mae'r tîm wedi'i chael gan y farnwriaeth, staff y llysoedd, cymdeithasau proffesiynol cyfreithiol a gwasanaethau cymorth i ddioddefwyr a thystion.
