Making our probate service simple, accessible and reliable (2)

In my first blog I covered the current performance of our probate service and what we are doing to make it quicker. In this blog I will explain the wider changes we are making to the service as well as pick up some of the other issues which have been raised.

My first blog acknowledged the current slowness in probate, and apologised directly for it. It set out what we are doing in tackling the issue and suggested some ways in which users could help us. The reasons for the delays were set out (new systems and increased work) and we are clear on what we need to do to recover the position as quickly as possible. Any help users can give us will be gratefully received (and a number are already being very supportive for which I am very grateful) as it will mean we can get back to normal sooner, but please be assured that in asking for help we are not seeking to avoid responsibility for improving both our performance and the overall system.

Reforms to our probate service will enable people to apply for grants of probate more simply and with greater confidence. Where we’ve already made changes we know they can make things better: nine out of ten people who have used the online application process are satisfied or very satisfied.

Progress so far: online applications

Our online service for personal applicants to apply for probate, where the deceased has left a will, has been publicly available since July 2018 and the ‘back end’ case management system supporting it is up and running too.

But, as I explained in my last blog, it’s not yet available to everyone. In particular, it’s not yet available to legal professionals. We will change that by making online services available in probate for all user groups (including legal professionals) and all types of probate applications by the end of the year.

We are also listening hard to feedback to continually improve the system. Following the initial roll-out of the new Grant of Probate, for example, there were concerns raised about us only naming the lead executor. We listened and we made changes as a result of what we heard.

Keeping the application process accessible for all

Our online application process is a new and additional way for people to apply for probate, but it is not the only way. People can still apply by completing and posting a paper form if they choose to.

For those that are able and willing to use it, the online process does have clear benefits. The application can be completed and submitted at any time of day (or night) on any day of the week and isn’t dependent on when the probate registry is open. It can be accessed from a device – computer, phone or tablet - at home, at work or on the move and means that people don’t have to travel to make an application.

We know that some of the people who have already used the online application consider this to be a real advantage.

A secure system you can trust

It has never been our role to test the genuineness of individual wills. But it is our job to make sure people know the consequences of lying to the court. The executor completes a statement of truth (or an oath for the paper process) which has penalties available to the courts if found to be fraudulent. The online statement of truth process is no different in terms of being certain about the identity of the applicant.

It is also our job to make sure our system can’t be abused or misused down the line. Our added counter-fraud measures include high security holograms; a digital seal instead of an embossed seal; and a digital signature instead of a ‘wet’ signature to make cheating the system even harder.

Inheritance tax

I know that there has also been some concern about the implications for estates in paying inheritance tax due to the delays. HMRC publishes guidance about paying inheritance tax. Probate applications are only processed when the relevant inheritance tax form has already been completed, so even with current delays of six to eight weeks those who apply in good time should be able to pay inheritance tax well within the six-month window.

Moving work, closing probate registries, retaining expertise

This month we confirmed that Birmingham Probate Registry would close  at the end of August. This is part of a longer-term strategy to centralise administrative work and support in Courts & Tribunals Service Centres (CTSCs) which are equipped with modern technology and where our staff have the right systems and training to provide more effective support to legal professionals and members of the public who use our service.

Moving work to national centres, underpinned by the right systems, helps us manage peaks and troughs of work better across different services; get better data about how we are performing and where we can make changes; and align working patterns to demand more effectively. In practice, it will mean more calls getting answered quicker, administrative work done more effectively, and better certainty for users about where their application or case is and what happens next.

In January, the first of these CTSCs opened and they now undertake probate work. Colleagues from across the probate service have been heavily involved in designing and testing these new ways of working and moving the work across. They have brought invaluable expertise and insight that is helping us to improve what we do.

Birmingham is the first registry to close and all affected staff who wished to remain with us have been redeployed. We know that these changes are not easy and I am grateful for the way the staff in Birmingham have been so professional throughout.

Ordering wills

I should also mention that, since the cost of ordering a copy of a will was reduced earlier in the summer, we have been receiving significantly more orders particularly through the Find a Will service on GOV.UK. This means it is taking much longer than usual to provide copies. Our supplier is bringing in a lot more resource to clear current applications and to process new requests more quickly, so things will start to improve and we’ll update our guidance about expected processing times as soon as we can be clearer about this. We’re sorry for the inconvenience and the extra frustration that this will undoubtedly cause.

I hope that this post, combined with my first blog, provides a comprehensive view of the reforms we are making to the probate service and why, as well as giving a clearer view of the issues we have faced and how we are working to overcome them. Y mis hwn bu inni gadarnhau y byddai cofrestrfa Brofiant Birmingham yn cau ddiwedd mis Awst.     My personal experience is that in 2016 when my mother in law died, we had no problems contacting the London Probate office whenever we called. Move on to last year when my husband's great aunt died, every time we rang the line was engaged no matter what time of the day it was. Hardly an improvement for the customer!
