Transforming Civil Justice – an update on the civil money claims procedure

My name is Clare Galloway and I’m the Service Manager for the Civil Money Claims project. I wanted to provide you with an update of what the project is looking to achieve and how we are going to do it.

Many of you will be familiar with the ambition set by Lord Justice Briggs in the Civil Court Structure Review. We want to make the civil justice system accessible to everyone, whatever their means so they can manage and resolve their disputes fairly and speedily. We’re developing a new digital service for lower value money claims which will provide a simple process for individuals and businesses to resolve disputes. This service will use a mix of technology, conciliation and judicial resolution allowing users to resolve money claim disputes in a simple, accessible and proportionate way.

However this is only one part of our ambitious plan to reshape civil justice. We’re also exploring how we can use technology to modernise and improve accessibility to the ‘traditional’ civil money claims procedures ensuring we focus on higher value County Court money claims as well.

Key Deliverables

  • Online Dispute Resolution (ODR)

We’re undertaking in-depth research into the different ODR practices currently in use in other countries and jurisdictions. We’ll be drawing on our our findings to help inform the development of our own systems. Our intention is to integrate ODR into our new digital service in order to aid dialogue and increase earlier conciliation and negotiation opportunities between different parties, where appropriate.

  • Procedures that are navigable for lay litigants as much as for lawyers

Work to establish a set of concise, litigant in person friendly rules will be required to support all new online procedures. The Ministry of Justice plans to introduce primary legislation to authorise the creation of a new Online Procedure Rules Committee for the purpose of making a new kind of procedure rules for selected classes of cases aimed at making litigation in courts and tribunals navigable for lay litigants as much as for lawyers, and harnessing modern IT for that purpose. This will provide vital underpinning for the Civil Money Claims Project.

In advance of this, the piloting of the new Civil Money Claims service will take place within the context of the existing Civil Procedure Rules. We have been working closely with the Civil Procedure Rule Committee over the past year to ensure the successful delivery of our first upcoming pilot.

  • Guidance

We’ll improve the user experience by embedding clear, concise and timely guidance and notifications within our services. This guidance will support the user through the process and reduce errors and failure demand.

How will we do this

To help us deliver the ambitious CMC vision by project closure we will be drawing on agile methodology. A key principle of agile working is to break the overall project down in to a series of manageable releases so that we can design, build and deliver iteratively.

The new streamlined Civil Money Claims services will be delivered over a series of 10 releases with each new release delivering additional and improved functionality on those previous. This approach allows us to learn quickly and make continual improvements to ensure the service meets user needs.

Next Steps

In summer 2017, the Civil Money Claims Project will launch its first private beta pilot focusing on the issue and response stage of the new online claims procedure. User numbers will be increased gradually and initially the scope of the procedure will be limited; only litigants in person, with claims of a value of £10k or less will be eligible to trial the new service.

This upcoming pilot is not intended to deliver the ‘online court’ in its entirety; that will take some time. Rather, this is the exciting first step in our journey that will eventually deliver a new and improved Civil Money Claims service.

Legal representatives

We’ve also recently begun the process of building a new online solution that will allow legal representatives to issue and serve a claim for an unspecified sum of money on behalf of their clients. We hope to launch a pilot later this summer and we’ll be engaging with legal representatives around the country to test the proposed design and gather feedback. Byddwn yn defnyddio ein canfyddiadau i helpu i lywio'r gwaith o ddatblygu systemau ein hunain. Ein bwriad yw integreiddio ODR i’n gwasanaeth digidol newydd er mwyn hwyluso trafodaethau a chynyddu’r cyfleoedd i gymodi a negodi yn gynharach rhwng gwahanol bartïon, lle y bo'n briodol.

  • Gweithdrefnau sy'n agored i drafodaeth i ymgyfreithwyr lleyg yn ogystal â chyfreithwyr

Bydd angen gweithio i sefydlu set o reolau cryno a chyfeillgar i ymgyfreithwyr drostynt eu hunain i gefnogi'r holl drefniadaethau newydd ar-lein. Mae'r Weinyddiaeth Cyfiawnder yn bwriadu cyflwyno deddfwriaeth sylfaenol i awdurdodi creu Pwyllgor Rheolau Trefniadaeth Ar-lein newydd at ddibenion gwneud math newydd o reolau trefniadaeth ar gyfer mathau penodol o achosion sydd wedi'u hanelu at wneud ymgyfreitha mewn Llysoedd a Thribiwnlysoedd yn fwy agored i ymgyfreithwyr drostynt eu hunain a chyfreithwyr yn ogystal â harneisio TG modern ar gyfer y diben hwnnw. Sut byddwn ni’n gwneud hyn

Byddwn yn defnyddio methodoleg ystwyth i'n helpu i gyflawni gweledigaeth uchelgeisiol y CMC erbyn dyddiad cau’r prosiect. Un egwyddor allweddol o weithio’n ystwyth yw’r broses o rannu’r prosiect cyffredinol i gyfres o gyhoeddiadau posibl fel y gallwn ddylunio, meithrin a darparu un ar ôl y llall.

Bydd y gwasanaeth symlach newydd ar gyfer hawlio arian yn y llys sifil yn cael ei gyflwyno dros gyfres o 10 cyhoeddiad gyda phob cyhoeddiad newydd yn cyflawni swyddogaeth ychwanegol a gwell na’r rhai blaenorol. Bydd nifer y defnyddwyr yn cynyddu’n raddol, ac i ddechrau, bydd cwmpas y weithdrefn yn gyfyngedig; dim ond ymgyfreithwyr drostynt eu hunain, gyda hawliadau gwerth £10k neu lai fydd yn gymwys i dreialu’r gwasanaeth newydd.

Ni fwriedir i’r cynllun peilot hwn sydd ar y gweill fod yn 'llys ar-lein' yn ei gyfanrwydd; bydd hynny'n cymryd amser. Yn hytrach, dyma'r cam cyffrous cyntaf yn ein taith a fydd, yn y pen draw, yn darparu gwasanaeth newydd a gwell ar gyfer Hawlio Arian yn y Llys Sifil.
