Keeping court custody suites safe

As the country continues to grapple with the challenges brought by COVID-19 and the latest national restrictions, we wanted to thank everyone involved in keeping the wheels of the criminal justice system turning. It has been imperative that they have continued to do so; for the sake of every complainant, victim, witness and defendant. Justice may happen differently at the moment; but it cannot stop. This has only been possible through close collaboration involving a network of people from across the justice system, including staff, judiciary, the legal profession, organisations that support public users and a range of contractors, among others.

This kind of team effort is evident in the administering of the Prison Escort Custody Services (PECS) contract, which is managed by HM Prisons & Probation Service on behalf of HMCTS, the police and the prisons/secure children’s estate. The PECS contract came into effect for 10 years from 29 August 2020 was awarded to two suppliers, with GeoAmey managing the North and Serco the South, covering England and Wales.

Given the current understandable anxieties about the new, more transmissible variants of COVID-19, we  wanted to take the time to reassure you about the steps we are all taking to keep custody suites in court safe for all who use them, as well as the additional measures in place when producing defendants to a court hearing from a prison.

Roles and responsibilities

Ensuring custody suites are safe is a joint effort. PECS is primarily responsible for providing the safe, decent, secure and timely transfer of prisoners and detainees to and from courts, and to oversee their care and security whilst in the court custody area or in the dock. PECS is also responsible for the safety and security of all other custody users or visitors during operating hours.

On the other hand, it is the responsibility of HMCTS to provide a safe, decent, secure court custody environment for the prisoners, PECS and all other custody visitors to work within. Throughout the pandemic, HMCTS and PECS have worked closely together to make custody suites COVID-secure and maintain these standards.

Safety measures in place

Since the start of the COVID-19 pandemic, PECS has worked with HMCTS to introduce a number of appropriate measures to manage the safety of staff, detainees within its care, and court custody suite visitors. This range of measures includes:

  • All operational court custody suites have been fully risk assessed, and are regularly reviewed, by HMPPS PECS Contract Delivery Managers (not supplier staff). These assessments have been reviewed in the light of the new COVID variant
  • The assessments cover all areas within the court custody suite including consultation rooms. Any consultation rooms that do not meet safety requirements (i.e. 2m social distancing or mitigating factors such as screens) have been taken out of use
  • Where conferencing facilities are limited or unavailable, locked down mobile phones have been provided and/or restricted use landlines have been installed to facilitate remote conferences
  • Custody Officers should wear Public Health England/Wales-approved face masks at all times while working, unless they are exempt for medical reasons
  • Defendants are strongly encouraged to wear face coverings
  • PECS has engaged with the Young Barristers’ Committee and the Bar Council and has amended processes for the entry and management of professional visitors, following their feedback
  • HMCTS has implemented regular touch point cleaning in all court custody suites and has made available basic cleaning materials (cloth & spray) to custody staff to enable additional cleans of touch points where need arises and where staff have capacity to do so.

HMCTS is also considering the implementation of further physical alterations to improve these environments. This includes reconfiguring space or moving fixed furniture to enable more consultation rooms to be used, and installing screens where appropriate.

Managing coronavirus cases

There have been recent concerns about prisoners possibly being presented at court with symptoms or while awaiting a test result. I want to reassure you that HMPPS is clear in its instructions – any detainee that shows coronavirus symptoms, has had close contact with a positive case, or has a positive test result will not be cleared to travel to court. HMPPS is also exploring whether we could use additional COVID-19 testing as a further safeguard, beyond our existing programme of testing prisoners on reception to custody.

Remaining vigilant

We recognise that the level of concern is high across society during this third national lockdown. And we want to reassure you that neither PECS nor HMCTS is complacent - we listen to suggestions for improvements and routinely review standards and implementation, but we only implement additional measures where they are supported by public health guidance and will make a difference to the safety of our buildings. If a custody visitor has concerns about a particular custody suite, they should contact their local court manager. Reporting issues locally will always ensure the swiftest resolution to a matter.

We all know that justice cannot stop and we must play our part in maintaining this essential service – for victims, witnesses, families in crisis and defendants waiting in custody. Together, we can make sure we work to the safety measures in place – and rigorously adhere to the hand-face-space guidance – to keep all those using custody suites and the wider court buildings safe.

Wrth i'r wlad barhau i fynd i'r afael â'r heriau a wynebir gan COVID-19 a'r cyfyngiadau cenedlaethol diweddaraf, roeddem eisiau diolch i bawb sy'n ymwneud â chadw’r system gyfiawnder troseddol i fynd rhagddo. Mae wedi bod yn hanfodol eu bod wedi parhau i wneud hynny; er lles pob achwynydd, dioddefwr, tyst a diffynnydd. Gall cyfiawnder ddigwydd yn wahanol ar hyn o bryd; ond ni all stopio. Dim ond drwy gydweithio agos sy'n cynnwys rhwydwaith o bobl o bob rhan o'r system gyfiawnder y bu hyn yn bosibl, gan gynnwys staff, y farnwriaeth, y proffesiwn cyfreithiol, sefydliadau sy'n cefnogi defnyddwyr cyhoeddus ac amrywiaeth o gontractwyr, ymhlith eraill.

O ystyried y pryderon presennol am yr amrywiolion newydd, mwy trosglwyddadwy o COVID-19, roeddem eisiau rhoi o'n hamser i'ch sicrhau am y camau rydym i gyd yn eu cymryd i gadw ystafelloedd cadw yn y ddalfa yn ddiogel i bawb sy'n eu defnyddio, yn ogystal â'r mesurau ychwanegol sydd ar waith wrth drosglwyddo diffynyddion i wrandawiad llys o garchar.

Rolau a chyfrifoldebau

Mae sicrhau diogelwch ystafelloedd cadw yn y ddalfa yn ymdrech ar y cyd. Mae PECS yn bennaf gyfrifol am ddarparu trosglwyddiad diogel, gweddus ac amserol o garcharorion i’r llys ac yn ôl o’r llys, ac i oruchwylio eu gofal a'u diogelwch tra yn ystafelloedd dalfa'r llys neu yn y doc. Mae PECS hefyd yn gyfrifol am ddiogelwch pob defnyddiwr dan glo neu ymwelwyr eraill yn ystod oriau gweithredu.

Ar y llaw arall, cyfrifoldeb GLlTEM yw darparu amgylchedd diogel a gweddus i'r carcharorion, PECS a phob ymwelydd arall yn nalfa’r llysoedd weithio ynddo. Drwy gydol y pandemig, mae GLlTEM a PECS wedi cydweithio'n agos i wneud yn siŵr bod yr ystafelloedd cadw yn y ddalfa yn ddiogel rhag COVID ac yn cynnal y safonau hyn.

Mesurau diogelwch ar waith

Ers dechrau pandemig COVID-19, mae PECS wedi gweithio gyda GLlTEM i gyflwyno nifer o fesurau priodol i reoli diogelwch staff, ceiswyr lloches sydd o fewn ei ofal, ac ymwelwyr i’r ddalfa yn y llys. Mae'r ystod hon o fesurau yn cynnwys:

• Mae pob ystafell weithredol yn nalfa'r llys wedi cael ei hasesu'n llawn, ac fe'i hadolygir yn rheolaidd gan Reolwyr Cyflawni Contractau PECS HMPPS (nid staff cyflenwyr). Adolygwyd yr asesiadau hyn yng ngoleuni'r amrywiolyn COVID newydd
• Mae'r asesiadau'n cwmpasu pob ardal yn ystafell ddalfa'r llys gan gynnwys ystafelloedd ymgynghori. Mae unrhyw ystafelloedd ymgynghori nad ydynt yn bodloni gofynion diogelwch (h.y. 2m o bellter cymdeithasol neu fesurau lliniaru fel sgriniau) allan o ddefnydd
• Os yw cyfleusterau cynadledda'n gyfyngedig neu os nad ydynt ar gael, darperir ffonau symudol a/neu llinellau tir cyfyngedig i hwyluso cynnal cynadleddau o bell
• Dylai Swyddogion y Ddalfa wisgo gorchuddion wyneb a gymeradwyir gan Iechyd Cyhoeddus Cymru/Puublic Health England bob amser wrth weithio, oni bai eu bod wedi'u heithrio am resymau meddygol
• Anogir diffynyddion i wisgo gorchuddion wyneb
• Mae PECS wedi ymgysylltu â'r Pwyllgor Bargyfreithwyr Ifanc a Chyngor y Bar ac wedi diwygio prosesau ar gyfer mynediad i ymwelwyr proffesiynol a'u rheoli, yn dilyn eu hadborth
• Mae GLlTEM yn glanhau pwyntiau cyffwrdd yn rheolaidd ym mhob ystafell ddalfa yn y llys ac mae wedi sicrhau bod deunyddiau glanhau sylfaenol (clwt a chwistrell) ar gael i staff y ddalfa er mwyn gallu glanhau pwyntiau cyffwrdd ychwanegol lle bo angen a lle mae gan staff y gallu i wneud hynny.

Mae GLlTEM hefyd yn ystyried rhoi newidiadau ffisegol pellach ar waith i wella'r amgylcheddau hyn. Mae hyn yn cynnwys ad-drefnu gofod neu symud dodrefn sefydlog i alluogi defnyddio mwy o ystafelloedd ymgynghori, a gosod sgriniau lle bo hynny'n briodol.

Rheoli achosion coronafeirws

Bu pryderon diweddar ynghylch carcharorion o bosibl yn cael eu cyflwyno yn y llys a hwythau gyda symptomau COVID-19 neu wrth aros am ganlyniad prawf COVID-19. Rwyf eisiau eich sicrhau bod gan HMPPS gyfarwyddiadau clir – ni fydd unrhyw geiswyr lloches sy'n arddangos symptomau coronafeirws, sydd wedi cael cysylltiad agos ag achos positif, neu sydd wedi profi’n bositif yn cael caniatâd i deithio i'r llys. Mae HMPPS hefyd yn ystyried a allem ddefnyddio profion COVID-19 ychwanegol fel amddiffyniad pellach, y tu hwnt i'n rhaglen bresennol o brofi carcharorion wrth iddynt gyrraedd y ddalfa.

Parhau i fod yn wyliadwrus

Rydym yn cydnabod bod lefel y pryder yn uchel ar draws cymdeithas yn ystod y trydydd cyfnod clo cenedlaethol hwn. Ac rydym am eich sicrhau nad yw PECS na GLlTEM yn hunanfodlon - rydym yn gwrando ar awgrymiadau ar gyfer gwelliannau ac yn adolygu safonau a gweithrediadau fel mater o drefn, ond dim ond pan fyddant yn cael eu cefnogi gan ganllawiau iechyd y cyhoedd y byddwn yn gweithredu mesurau ychwanegol ac os ydynt yn gwneud gwahaniaeth i ddiogelwch ein hadeiladau. Os oes gan ymwelydd i’r ddalfa bryderon am ystafell ddalfa benodol, dylent gysylltu â'u rheolwr llys lleol. Bydd riportio materion yn lleol bob amser yn sicrhau'r ateb cyflymaf i’r mater hwnnw.

Gallwch hefyd roi adborth yn ganolog gan ddefnyddio ein gwasanaeth gadewch inni wybod ar GOV.UK. Bydd un o'n tîm canolog yn mynd ar drywydd hyn gyda'r llys neu dribiwnlys lleol, felly bydd y rheolwyr lleol perthnasol yn gallu mynd i'r afael â'r pryder ac ymateb iddo.

Gwyddom i gyd na all cyfiawnder ddod i ben a rhaid inni chwarae ein rhan i gynnal y gwasanaeth hanfodol hwn – i ddioddefwyr, tystion, teuluoedd mewn argyfwng a diffynyddion sy'n aros yn y ddalfa. Gyda'n gilydd, gallwn sicrhau ein bod yn gweithio yn unol â'r mesurau diogelwch sydd ar waith – a glynu’n drylwyr at y canllawiau dwylo-wyneb-pellter – i gadw pawb sy'n defnyddio ystafelloedd y ddalfa a'r adeiladau llys ehangach yn ddiogel.
