Responding to a global pandemic within the family courts

It’s now six weeks since the world as we knew it changed, and the impacts of the coronavirus started to affect our professional and private lives.

While many businesses and public services have had to close temporarily, many of the important pillars of our society – including courts and tribunals - have continued to provide essential services. This is thanks to a combination of hard work, collaboration with all our justice partners, and adapting to technology - in some cases using it in ways we wouldn’t have thought possible six weeks ago.

Every jurisdiction has found ways to navigate the challenges coronavirus has brought to courts and tribunals. But, as I have spent most of my career working within the family courts, I want to focus on what the last few weeks have been like in that particular jurisdiction within HMCTS.

Embracing technology

Despite an increasing use of technology in recent years, the family court still largely operates on paper and with physical, face-to face-hearings.

And yet, almost overnight, we’ve introduced remote hearings in nearly every area. That’s been down to the hard work and dedication of all those involved, including the legal profession, Cafcass, Cafcass Cymru, local authorities, HMCTS staff, the judiciary and third-sector support agencies, to name but a few. Thanks to their innovation and passion, they have pulled together to continue to operate and perform their vital roles in the family system.

However, remote hearings on their own are not the answer in every case. Indeed, the President of the Family Division asked for a rapid review into the use of remote hearings in the family court, which will help the judiciary with their decisions on what hearings are appropriate for remote hearings.

Equally, the sheer logistics of conducting hearings remotely naturally presents challenges . Many people have had to learn how to use new technology while we’ve been rapidly increasing our audio and video resources.

And, in the coming weeks, we’ll consider whether we should explore using new technology in the family courts, which would allow parties in a case to appear remotely.

It’s unsurprising that those working in the family justice system have collectively stepped up and, where needed, stepped in, for example making arrangements for remote hearings to help ensure that the family courts continue to operate. As things settle down and we turn to some sort of new ‘normal’, I hope this attitude is not lost. We’ll need to continue to work together to find solutions and understand and acknowledge the difficulties we are each facing so that we can do our best to overcome them.

Digital services

Together we have been able to ensure that not only the most essential parts of family work progress, those involving the safety of children and victims of domestic abuse, but also that some of the less immediately urgent work (but no less important) such as divorce, continue. And when I say ‘we’ I mean everyone who continues to work tirelessly each day, particularly the people who cannot work remotely and need to continue to go into court buildings and offices.

While there has been a focus on hearings, a lot of work in the family jurisdiction continues away from the court room.

HMCTS has worked hard over the last few years to digitise the divorce and probate services and these two areas of work have been relatively easy to keep up-to-date.

On top of the largely automated processes in place, we have been able to assign staff to work remotely. Our digital services mean that the parties can also work remotely too. Our divorce and probate services are available for both the public and professional users, and I really do encourage you to make use of them if possible. What’s more, by applying online you can pay online and receive updates about the progress of your case without needing to contact us.

While not all fully reformed we also have digital channels for a variety of other work, most notably the application for private disputes over spending time with children.

More details on our online services can be found on GOV.UK and I would urge you all to make full use of them. More generally, please consider whether it is essential to phone, email or write to a court during the pandemic. It is only right that we focus on the most urgent work at this time.

Preparing for a new normal

Despite our best efforts to keep things moving there will undoubtedly be fewer cases being disposed of, although immediate steps will have been taken to make interim orders where appropriate. Thoughts are already turning to how we deal with this..

A working group is already meeting between some of the key partners in the family court to focus on making those plans now and is ensuring the family justice system is as best placed as possible once current restrictions are lifted.

There will of course be no magic answers, but I do know that by continuing to work together to find solutions and being understanding of the pressures we are all facing we will get through this.

I firmly believe that once things return to a new normal, the system will be stronger thanks to closer engagement and new ways of working which this crisis has forced upon us.

Ymateb i bandemig byd eang o fewn y llysoedd teulu

Bellach mae chwe wythnos wedi mynd heibio ers i’r byd yr oeddem yn gyfarwydd ag o, newid, ac i effeithiau coronafeirws  ddechrau effeithio ein bywydau proffesiynol a phreifat.

Tra bod nifer o fusnesau a gwasanaethau cyhoeddus wedi cau dros dro, mae sawl un o bileri pwysig ein cymdeithas – gan gynnwys y llysoedd a’r tribiwnlysoedd – yn dal i ddarparu gwasanaethau hanfodol. Mae hyn o ganlyniad i gyfuniad o waith caled, cydweithio gyda phob un o’n partneriaid cyfiawnder, ac addasu i dechnoleg – mewn rhai amgylchiadau ei ddefnyddio mewn dulliau na fyddem wedi eu dychmygu chwe wythnos yn ôl.

Cofleidio technoleg

Er y cynnydd mewn defnyddio technoleg yn ystod y blynyddoedd diwethaf, mae’r llys teulu yn dal i weithredu gan fwyaf trwy bapur a gwrandawiadau corfforol, wyneb yn wyneb.

Ac eto, bron dros nos, rydym wedi cyflwyno gwrandawiadau o bell bron ym mhob maes.  Mae hynny wedi digwydd o ganlyniad i waith caled ac ymroddiad pawb a oedd yn gysylltiedig â hyn, gan gynnwys y proffesiwn cyfreithiol, Cafcass, Cafcass Cymru, awdurdodau lleol, staff GLlTEM, y farnwriaeth ac asiantaethau yn y trydydd sector sy’n cynnig cymorth, i enwi dim ond rhai. Diolch i’w harloesedd a’u hangerdd, maent wedi tynnu efo’i gilydd i barhau i weithredu eu swyddogaethau pwysig o fewn y system teulu.

Fodd bynnag, nid yw gwrandawiadau o bell ar ben eu hunain yn rhoi’r ateb ymhob achos.  Yn wir, mae Llywydd yr Adran Teulu wedi gofyn am adolygiad buan ar ddefnyddio gwrandawiadau o bell yn y llys teulu, a fydd yn cynorthwyo’r farnwriaeth gyda’u penderfyniadau ar pa wrandawiadau sy’n briodol ar gyfer gwrandawiadau o bell.

Yn ogystal, mae ystyriaethau aruthrol y  logisteg o gynnal gwrandawiadau o bell yn naturiol yn heriol.  Mae nifer o bobl wedi gorfod dysgu sut i ddefnyddio’r dechnoleg newydd tra ein bod wedi bod wrthi’n cynyddu ein hadnoddau fideo a sain yn gyflym.

Hefyd, yn yr wythnosau i ddod, byddwn yn ystyried a ddylem edrych i mewn i ddefnyddio technoleg newydd yn y llysoedd teulu, a fyddai’n caniatau i bartion i ymddangos o bell.

Does dim syndod bod y rhai sy’n gweithio yn y system cyfiawnder teulu wedi gweithio gyda’i gilydd i ymateb i’r her, a phan fo’r angen, wedi ymateb trwy wneud trefniadau ar gyfer gwrandawiadau o bell fel bod y llysoedd teulu yn gallu parhau i weithredu. Fel y bydd pethau’n setlo i lawr a’n bod yn wynebu’r ‘normal’ newydd, gobeithiaf y bydd yr ymagwedd hon yn parhau.  Bydd angen i ni i barhau i weithio gyda’n gilydd i ddod o hyd i ddatrysiadau, i ddeall ac i gydnabod yr anawsterau y mae pob un ohonom yn eu hwynebu, fel y gallwn wneud ein gorau i’w gorchfygu.

Dylech barhau i roi gwybod i ni am eich pryderon, eich awgrymiadau a’ch diweddariadau o ran cynnydd.  Gallwch ddefnyddio’r cyfleuster ar gyfer sylwadau isod i ofyn cwestiynau i ni ac fe wnawn ateb y rhai sy’n canolbwyntio ar faterion gweithredol presennol yn y llysoedd teulu.  Byddwn yn clystyru cwestiynau os cawn nifer ar yr un thema.

Gwasanaethau Digidol

Gyda’n gilydd rydym wedi llwyddo i sicrhau bod y gwaith teulu mwyaf hanfodol yn mynd yn ei flaen, y gwaith hynny sy’n ymwneud gyda diogelwch plant a’r rhai sy’n dioddef trais domestig, ond yn ogystal bod peth o’r gwaith sydd ddim cweit efo’r un lefel o frys (ond ddim yn llai pwysig) megis ysgariad, yn parhau.  A  phan dwi’n cyfeirio  at ‘ni’ dwi’n golygu pawb sy’n parhau i weithio’n ddi-flino bob dydd, yn enwedig y rhai sydd ddim yn gallu gweithio o adref ac sy’n dal i orfod mynd i’r llys neu’r swyddfa.

Tra bod cryn dipyn o ganolbwyntio ar wrandawiadau, mae lot o’r gwaith yn yr awdurdodaeth teulu yn digwydd y tu allan i’r ystafell llys.

Mae GLlTEM wedi gweithio’n galed dros y blynyddoedd diwethaf i wneud gwasanaethau ysgariad a phrofiant yn ddigidol ac mae’r ddau faes gwaith hyn wedi bod yn gymharol rwydd i’w cadw’n gyfredol.

Yn ogystal â’r prosesau awtomataidd sydd mewn lle, rydym hefyd wedi gallu cael staff i weithio o bell.   Mae ein gwasanaethau digidol yn golygu bod y partïon yn gallu gweithio o bell hefyd.  Mae ein gwasanaethau ysgariad a phrofiant ar gael i’r cyhoedd a defnyddwyr proffesiynol, a hoffwn eich annog i’w defnyddio os yn bosibl.  Yn ychwanegol, trwy wneud cais arlein gallwch dalu arlein a chael diweddariadau ar sut mae eich cais yn mynd yn ei flaen heb orfod cysylltu gyda ni.

Er nad ydynt wedi cael eu diwygio’n llwyr mae gennym hefyd sianelau digidol ar gyfer amrywiaeth o waith arall, yn enwedig gwneud cais am anghydfodau prefiat dros dreulio amser efo plant.

Paratoi ar gyfer y normal newydd

Er ein hymdrechion gorau i gadw pethau i fynd, yn ddios fe fydd llai o achosion yn cael eu hymdrin â hwy, er bydd camau wedi eu cymryd i wneud gorchmynion interim yn y cyfamser.  Rydym eisoes yn meddwl am sut i ymdrin â hyn.

Mae gweithgor o bartneriaid allweddol yn y llys teulu eisoes yn cyfarfod i wneud y cynlluniau hyn gan sicrhau bod y system cyfiawnder teulu yn y cyflwr gorau posibl, unwaith y bydd y cyfyngiadau presennol yn cael eu codi.

Ni fydd atebion syml wrth gwrs, ond gwn y byddwn yn llwyddo trwy barhau i weithio gyda’n gilydd i gael atebion a thrwy fod yn ymwybodol o’r pwysau sy’n wynebu pob un ohonom.

Rwy’n credu’n gryf unwaith y bydd pethau’n setlo i’r normal newydd, y bydd y system yn gryfach a hynny oherwydd ymgysylltiad agosach a dulliau newydd o weithio a orfodwyd arnom gan yr argyfwng hwn.
